TERMS OF SERVICE

These Terms of Service ("Terms") govern your use of the TORQ iOS application ("the App") and the TORQ website at torqapp.co.uk ("the Site"). By downloading the App, purchasing access, or using the Site, you agree to these Terms.

If you don't agree to any part of these Terms, please don't use TORQ.

1. Who We Are

TORQ is operated by Oliver, a sole trader based in the United Kingdom. You can reach us via Instagram at @TorqApp.

These Terms form a legally binding agreement between you and us.

2. What TORQ Is

TORQ is a strength scoring iOS app for intermediate and advanced lifters. The App scores logged lifts against population data using a bodyweight-adjusted estimated 1 rep max formula and places each lift into one of six strength tiers.

TORQ is a fitness and strength measurement tool. It is not medical advice, not a coaching service, and not a substitute for professional guidance from a qualified personal trainer, physiotherapist, or medical professional.

3. Eligibility

You must be at least 16 years old to use TORQ. By using the App, you confirm you meet this requirement.

You are responsible for ensuring that strength training is appropriate for your health, fitness level, and any pre-existing conditions. Consult a doctor before beginning any new training programme. We are not responsible for injuries or health consequences arising from use of the App.

4. Your Access to TORQ

TORQ offers two ways to access premium features:

4.1 Lifetime Access (one-time payment)

A one-time payment unlocks all premium features for the lifetime of the App. Lifetime access is processed via Stripe on our website. The current price is shown at checkout.

• One payment. No subscription. No recurring charges.
• All current and future premium features included.
• Access is delivered via TestFlight (during pre-launch) or App Store redemption code (post-launch).

4.2 Subscriptions (via the App Store)

Subscriptions are processed by Apple through the App Store. The available plans are:

• Monthly: £7.99 per month, with a 7-day free trial (payment method required, charged automatically if not cancelled before the trial ends)
• Annual: £39.99 per year

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. Your iTunes Account is charged at confirmation of purchase and at each renewal.

5. Apple Standard EULA

Your use of the App downloaded from the App Store is also subject to Apple's Standard End User License Agreement. Where these Terms conflict with the Apple EULA in relation to App Store distribution, the Apple EULA takes precedence.

6. License to Use the App

Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable, revocable license to use the App on iOS devices you own or control, for personal non-commercial use only.

You may not:

• Copy, modify, reverse-engineer, or create derivative works of the App
• Sell, sublicense, or otherwise distribute the App or any of its content
• Use the App to harass, harm, or violate the rights of others
• Attempt to bypass any technical limitations or security measures in the App
• Use automated systems or bots to interact with the App or Site

7. Intellectual Property

The App, the Site, the TORQ name, logo, tier system terminology ("Dusty", "Cooking", "Slept On", "Decent", "Built", "Goated"), strength scoring methodology, design, and all related content are the property of TORQ and are protected by UK and international intellectual property laws.

You retain ownership of any data you enter into the App (your lift logs, bodyweight, etc.). That data stays on your device and is yours.

8. Refunds

Refund terms are detailed in our Refund Policy. In short:

• Lifetime access — full refund if TORQ doesn't ship within 12 months of your purchase date. No questions asked.
• App Store subscriptions — refund requests are handled by Apple, not by us. See the Refund Policy for instructions.

9. Service Changes and Termination

We may update, modify, or discontinue features of the App at any time. For premium features specifically:

• If we discontinue a premium feature, lifetime access holders will receive a replacement of equivalent value or, where this is not possible, a partial refund.
• If we discontinue TORQ entirely within 12 months of your lifetime purchase, you are entitled to a full refund under our Refund Policy.

We may suspend or terminate your access if you breach these Terms, attempt to defraud us, or use the App in a way that harms us or other users.

10. Disclaimers and Limitation of Liability

TORQ is provided "as is" without warranties of any kind. We do not guarantee that the App will be uninterrupted, error-free, or that the strength scoring is suitable for any particular purpose.

Strength scoring is an estimate based on population data and the Epley formula. Your true 1 rep max may differ. Your tier is an indication, not a verdict.

To the maximum extent permitted by UK law, our total liability to you for any claim arising from these Terms or your use of TORQ is limited to the amount you paid us for the App in the 12 months preceding the claim.

We are not liable for:

• Injuries sustained during training or as a result of relying on the App's recommendations
• Loss of data caused by device failure, iOS updates, or your own actions
• Indirect, consequential, or incidental damages
• Loss of profits, revenue, or business opportunity

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under UK consumer law, including liability for death, personal injury caused by our negligence, or fraud.

11. Your Consumer Rights

If you are a consumer in the United Kingdom or European Union, you have statutory rights that cannot be waived by these Terms, including under the Consumer Rights Act 2015 and equivalent EU legislation. Nothing in these Terms affects those rights.

12. Privacy

Your privacy is covered separately in our Privacy Policy. The short version: the app collects nothing, the website uses Meta Pixel only, and Stripe handles payments.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be noted at the top of this page (the "Last Updated" date) and posted on the homepage for at least 30 days. Continued use of TORQ after changes take effect constitutes acceptance of the updated Terms.

If you don't agree to updated Terms, you may stop using TORQ. For lifetime access purchasers, if a material change negatively affects your access, you may request a pro-rata refund.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, except that consumers retain the right to bring proceedings in their country of residence as required by local law.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect.
